ORDINANCE NO. 9

AN ORDINANCE TO PROHIBIT THE RUNNING AT LARGE OF DOGS IN THE STREETS, ALLEYS, PARKS AND OTHER PUBLIC PLACES IN THE VILLAGE OF LAKEVIEW AND DOGS BEING AN ANNOYANCE BECAUSE OF HABITUAL BARKING, YELPING OR HOWLING; TO PROVIDE FOR THE IMPOUNDING OF SUCH DOGS AND TO PROVIDE PENALTIES FOR THE VIOLATION THEREOF.

THE VILLAGE OF LAKEVIEW ORDAINS:

SECTION 1. Presumption of Ownership
Any person who shall permit any dog to remain about any premises owned or occupied by him shall be deemed the owner of such dog for the purpose of this Ordinance.

SECTION 2. Restrictions
No person owning, possessing or having charge of any dog, shall permit such dog:
(a) To be unconfined at any time unless in the custody of some person of responsible age.
(b) To be an annoyance or nuisance in the vicinity where kept because of loud barking, yelping or howling, or by reason of damaging or tres­passing upon the property of others.

SECTION 3. Seizure and Impounding of Dogs
(a) Any dog found at large in the Village or which is suspected of having rabies or having bitten any person or animal may be seized or im­pounded by the Village of Lakeview Police or agent thereof.
(b) It shall be the duty of the Police Department to give notice to the owner of any impounded dog if the owner can be located.
(c) If any dog in violation of this ordinance cannot be captured, the owner may be cited with an appearance ticket to appear in 64B District Court.

SECTION 4. Violation and Penalty
Any person or persons who shall be found guilty of a violation of this Ordinance, shall be punished, upon conviction thereof, by a fine of not more than $100.00 Dollars, or by imprisonment in the common jail of Montcalm County for a period of not exceeding ninety days, or by both such fine and imprisonment in the discretion of the Court, together with the costs of prosecution for such violation as such Court may order, and in case such Court shall impose a fine and costs only, the person or persons convicted, upon failing to pay such fine and costs, may be sen­tenced by the said Court to be imprisoned in the said jail for a term not exceeding ninety days, unless payment thereof be sooner made.

SECTION 5. Adoption of Ordinance
This Ordinance shall be in full force and effect from and after the 8th day of July, 1983.
This Ordinance shall be published in full in the Lakeview Enterprise on the 16th day of June, 1983.
